A seven-member national independent investigative commission headed by former BGB director general A L M Fazlur Rahman was announced by the government today to reexamine the BDR atrocity that took place at Pilkhana on February 25 and 26, 2009.
To this aim, the Cabinet Division released a notification in the gazette.
The remaining six members are: retired joint secretary Munsi Alauddin Al Azad; retired DIG Dr. M Akbar Ali; Md. Shariful Islam, Associate Professor of the Political Science Department of Dhaka University; Brigadier General Md. Saidur Rahman; Bir Pratik (Retd.); and Md. Shahnewaz Khan Chandan, Assistant Professor of the Institute of Education and Research of Jagannath University.
The commission has been asked to submit its report within 90 days from the publication of the notification.
Speaking at a BGB Day event at BGB headquarters on Monday, Home Affairs Advisor Lieutenant General Jahangir Alam Chowdhury (Retd) announced the commission’s formation.
According to the notification, the Supreme Court’s High Court Division ordered the creation of a National Independent Investigation Committee in response to a writ petition to re-investigate the savage massacre that took place on February 25 and 26, 2009, at the BDR headquarters in Pilkhana, then known as the BDR mutiny.
Therefore, the government, as per the Section 3 of the Commissions of Inquiry Act, 1956 (Act No. VI of 1956), has constituted a National Independent Commission of Inquiry to uncover the nature of the domestic and foreign conspiracies and actual events involved in the massacre that took place on February 25 and 26, 2009 at the then BDR Headquarters, Pilkhana, in the name of the BDR mutiny, and to identify the criminals, conspirators, accomplices, destroyers of evidence, perpetrators of the incident and other issues related to the carnage.
The terms of reference of the National Independent Commission of Inquiry shall be as follows:
To uncover the nature and nature of the incident that took place on February 25 and 26, 2009 at the then BDR Headquarters, Pilkhana;
Identifying the perpetrators, conspirators, destroyers of evidence of the incident, instigators and other related matters, including domestic and foreign criminal organizations. of the murders and other crimes committed during the incident;
identifying the responsible parties, determining the involvement of other domestic and foreign individuals who diverted the incident or assisted in causing it, and determining the nature of other crimes committed during the murder and before/after the murder in the aforementioned incident;
identifying the people who failed to take action to stop other crimes, such as murder; and (e) adding the real offenders who haven’t been mentioned in the pertinent instances, while maintaining the accused’s criminal responsibility in the cases that are relevant.
Anybody accused of committing the offense may be summoned and questioned by the Commission when it visits any location in Bangladesh.
The Ministry of Home Affairs’ Public Security Department will support the Commission of Inquiry in all ways, including secretarial support. It will also cover the Commission’s costs and may designate any individual working for the Republic to assist the Commission.
With the caveat that if the Head or any member of the Commission wants to carry out their duties without compensation or does not want to receive such facilities, they can get the Honorable Chief Advisor to the Interim Government’s approval. The Head and members of the Commission will be given the official rank, salary, honorary allowance, and facilities decided by the government.
