Trump administration seeks delay in tariff refunds battle

A court filing on Friday revealed that US President Donald Trump’s administration is attempting to postpone legal actions related to tariff refunds for importers, a week after the Supreme Court overturned his international duties.

In addition to opening the door to what analysts predict would be a convoluted, legally complex refund procedure as importers battle for their money back, this week’s high court decision was a striking rebuke of the president’s centerpiece economic program.

The administration argued Friday for a delay of up to four months, before litigation on refunds is brought up again before the US Court of International Trade.

“In a case on review from a federal court, the Supreme Court sends down its judgment 32 days after entry of judgment,” the government said in its filing to the United States Court of Appeals for the Federal Circuit.

It argued that the court should allow for a further delay of “90 days to allow the political branches an opportunity to consider options.”

In August of last year, the US Court of Appeals for the Federal Circuit declared that many of Trump’s tariffs were unlawful, but it sent the refund issue back to the Court of International Trade.

But because Trump appealed the issue to the Supreme Court, it postponed giving its mandate.

However, the supreme court concluded last week that Trump had overreached himself by imposing broad duties on a number of nations, overturning them. Trump’s sector-specific tariffs on products like steel and automobiles were unaffected by this decision.

Trump has already used a different statute to put a fresh 10-percent tariff on imports into the US in reaction to the verdict.

Earlier Friday, Trump lashed out again at the top court’s ruling that struck down his tariffs, claiming that this would allow countries and companies to continue “ripping off” the United States.

“Is a Rehearing or Readjudication of this case possible???” he wrote on his Truth Social platform.
